Please read these Terms of Service carefully before using the EasyKids2Go platform. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and EasyKids2Go ("Company," "we," "us," or "our") governing your access to and use of the EasyKids2Go platform, including our website at easykids2go.com, mobile applications, and all related services (collectively, the "Platform").
By creating an account, downloading our mobile application, or otherwise accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
Age Requirement: You must be at least 18 years of age to create an account and use the Platform. The Platform is designed for use by adults (parents, guardians, drivers, and administrators) to manage children's transportation. Children are not permitted to create accounts or directly access the Platform.
2. Description of Service
EasyKids2Go is a software-as-a-service (SaaS) platform that provides child transportation management tools for transportation companies, their drivers, and the parents or guardians of children being transported. The Platform includes, but is not limited to, the following features:
Route Management: Creation and management of transportation routes, stops, and schedules.
Real-Time GPS Tracking: Live location tracking of drivers during active transportation trips, visible to parents and administrators.
Push Notifications: Automated alerts for trip events including pickup, en route, and drop-off confirmations.
Pickup Verification: Digital signatures and QR code scanning to verify authorized pickups and drop-offs.
In-App Messaging: Communication between parents, drivers, and administrators.
Fleet Management: Vehicle tracking, driver assignment, and organizational management for administrators.
Payment Processing: Subscription billing for transportation companies (coming soon, powered by Stripe).
The Platform serves as a technology tool for transportation companies. EasyKids2Go does not itself provide transportation services, employ drivers, or operate vehicles. Transportation companies using the Platform are independent entities responsible for their own operations, compliance, and service quality.
3. Account Registration and Responsibilities
3.1 Account Types
The Platform supports the following account types, each with different access levels and responsibilities:
Administrator Accounts: Held by transportation company operators to manage their organization, routes, drivers, children, and parent relationships.
Driver Accounts: Held by drivers to access assigned routes, conduct trips, and communicate with parents.
Parent/Guardian Accounts: Held by parents or guardians to track their children's transportation, communicate with drivers, and verify pickups.
3.2 Registration Accuracy
You agree to provide accurate, current, and complete information during registration and to update your information promptly if it changes. You are responsible for maintaining the accuracy of all information associated with your account.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials (email and password).
You agree to notify us immediately if you become aware of any unauthorized use of your account.
You are responsible for all activities that occur under your account, whether or not you authorized them.
We reserve the right to suspend or disable any account that we believe has been compromised.
3.4 One Account Per Person
Each individual may hold only one account of each type. Creating multiple accounts to circumvent restrictions, abuse the service, or for any deceptive purpose is prohibited.
4. Acceptable Use Policy
You agree to use the Platform only for its intended purpose of managing children's transportation. You agree not to:
Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law.
Provide false, misleading, or fraudulent information, including but not limited to impersonating another person or misrepresenting your relationship to a child.
Attempt to gain unauthorized access to other users' accounts, our systems, or any data not intended for you.
Interfere with or disrupt the Platform's operation, servers, or networks, including through the transmission of malware, viruses, or harmful code.
Use automated tools (bots, scrapers, crawlers) to access the Platform without our prior written consent.
Reverse engineer, decompile, or disassemble any part of the Platform.
Share your account credentials with any third party.
Use the GPS tracking features for any purpose other than monitoring authorized transportation trips.
Harass, threaten, or abuse other users through the Platform's messaging features.
Upload or transmit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Use children's information for any purpose unrelated to transportation services.
Attempt to extract or compile data about children or families for commercial purposes.
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without prior notice. We may also report violations to law enforcement if we believe illegal activity has occurred.
5. Children's Safety and Data
Given that our Platform involves the transportation of children, we hold all users to the highest standards regarding children's safety and data protection:
Administrators are responsible for ensuring that all drivers operating under their organization have undergone appropriate background checks and meet applicable regulatory requirements.
Drivers must use the Platform's verification tools (QR codes, digital signatures) to confirm authorized pickups and drop-offs.
Parents/Guardians are responsible for keeping their contact information and authorized pickup persons up to date.
All users must report any safety concerns immediately through the Platform or by contacting the transportation company directly.
The Platform uses GPS technology to provide real-time location tracking during active transportation trips. By using the Platform:
Drivers consent to their device's location being tracked and shared with parents and administrators during active trips. Location tracking is active only while conducting authorized routes and may be disabled between trips.
Parents/Guardians acknowledge that GPS tracking provides approximate location data and may be affected by factors such as signal strength, weather, device settings, and other technical limitations.
Administrators agree to use GPS data solely for transportation management purposes and not for any unauthorized surveillance.
GPS location data is retained for 90 days after trip completion and is then securely deleted, as described in our Privacy Policy.
7. Payments and Subscriptions
Transportation companies (administrators) subscribe to EasyKids2Go through paid subscription plans. Payment terms are as follows:
Subscription plans, pricing, and features are as described on our website and may be updated from time to time.
Payment processing is handled by Stripe, a PCI-compliant third-party payment processor. We do not store full credit card numbers on our servers.
Subscriptions are billed on a recurring basis (monthly or annually) unless cancelled before the next billing cycle.
All fees are non-refundable except as required by applicable law or as expressly stated in a separate written agreement.
We reserve the right to change pricing with 30 days' advance notice. Continued use after price changes constitutes acceptance.
Parent and driver accounts are provided at no charge as part of the transportation company's subscription.
8. Intellectual Property
The Platform, including its design, code, features, content, trademarks, logos, and documentation, is the proprietary property of EasyKids2Go and is protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, or create derivative works based on the Platform without our prior written consent.
The EasyKids2Go name, logo, and all related marks are trademarks of EasyKids2Go. You may not use these marks without our prior written permission.
9. User Content
"User Content" refers to any information, messages, images (such as profile photos), digital signatures, or other materials that you submit, upload, or transmit through the Platform.
You retain ownership of your User Content. By submitting User Content, you grant EasyKids2Go a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit that content solely for the purpose of operating and providing the Platform.
You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate any third party's rights.
We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.
We do not claim ownership of User Content, and this license terminates when you delete your content or your account, except for content that has been shared with other users or that we are required to retain by law.
10. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF GPS LOCATION DATA OR ANY OTHER INFORMATION PROVIDED THROUGH THE PLATFORM.
EasyKids2Go is a technology platform and does not provide transportation services directly. We are not responsible for:
The conduct, qualifications, or actions of any driver or transportation company using the Platform.
The safety, quality, legality, or timeliness of transportation services provided by transportation companies.
Delays, interruptions, or inaccuracies in GPS tracking caused by technical limitations, device issues, or network conditions.
Any disputes between parents, drivers, and transportation companies.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
IN NO EVENT SHALL EASYKIDS2GO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
Nothing in these Terms limits our liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless EasyKids2Go and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
Your use of the Platform or violation of these Terms.
Your violation of any applicable law or regulation.
Your User Content or any information you provide through the Platform.
Your infringement of any third party's rights.
Any dispute between you and another user of the Platform.
For transportation company administrators, this indemnification extends to claims arising from the transportation services provided by your organization, your drivers' conduct, and your handling of children's data.
13. Termination
13.1 Termination by You
Parents/Guardians and Drivers: You may delete your account at any time through the app settings or by contacting us at easykids2go@gmail.com.
Administrators: You may cancel your subscription and close your organization's account by contacting us. Cancellation takes effect at the end of the current billing period.
13.2 Termination by Us
We may suspend or terminate your account, with or without notice, if:
You violate these Terms or our Acceptable Use Policy.
We reasonably believe your account has been compromised or is being used fraudulently.
We are required to do so by law or legal process.
We determine that your use of the Platform poses a risk to the safety of children or other users.
Your subscription payment fails and remains unresolved after reasonable notice.
13.3 Effect of Termination
Upon termination, your right to access and use the Platform ceases immediately.
We may retain certain data as required by law or as described in our Privacy Policy.
Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue to apply.
Termination does not relieve you of any obligations that accrued prior to termination, including payment obligations.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
14.1 Informal Resolution
Before initiating formal proceedings, you agree to first contact us at easykids2go@gmail.com to attempt to resolve any dispute informally. We will make good-faith efforts to resolve the matter within 30 days.
14.2 Binding Arbitration
If a dispute cannot be resolved informally, you and EasyKids2Go agree to resolve it through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding.
14.3 Class Action Waiver
YOU AND EASYKIDS2GO AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
14.4 Exceptions
Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or to address urgent safety concerns.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes:
We will update the "Last Updated" date at the top of this page.
We will notify users through the Platform (e.g., in-app notification) at least 30 days before material changes take effect.
For changes that materially affect administrators' subscription terms, we will provide direct email notice.
Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must stop using the Platform and close your account.
